담배 단순 포장 관련 법규
정부는 담배 규제 10대 조치의 새로운 단계를 추진하기 위한 3건의 하위 법령을 관보에 게재했습니다. 여기에는 일반 담배 제품의 단순 포장에 대한 구체적인 법적 요건을 수립하고, 이에 맞춰 포장지의 건강 경고 문구를 개정하는 내용이 포함된다.
해당 법령은 10월 7일 입법회에 제출되어 '부정적 심사(negative vetting)' 절차를 거치게 되며, 규정된 조치들은 2027년 3월 1일부터 발효된다. 이후 9개월간의 유예 기간을 거쳐 2027년 12월 1일부터 전면 시행될 예정이다.
단순 포장은 브랜드 로고, 다양한 색상, 그리고 슬로건이나 문양 같은 장식적 요소를 제거하여 브랜드가 주는 효과를 근본적으로 약화시킨다. 이미 27개 국가 및 지역에서 시행된 바 있으며, 흡연율을 효과적으로 낮춘다는 사실이 경험적으로 입증되었다.
또한 정부는 지난 8년간 사용해 온 12가지 건강 경고 문구의 내용을 개정하여 경고 효과를 한층 강화할 방침이다. 개정안은 관련 질병으로 인한 장애, 신체 훼손, 삶의 질 저하 등을 강조하는 내용을 담고 있다.
아울러 일부 담배 회사가 소비자를 유인하기 위해 '라이트(light)'나 '저타르(low tar)' 같은 표현을 사용하는 점을 고려하여, 오해를 방지하기 위해 포장지에 타르 및 니코틴 함량을 표기해야 했던 의무 규정을 삭제했다.
정부는 단순 포장과 담배 세금 납세 증지가 상호 보완적인 관계에 있다고 설명했습니다. 단순 포장은 수요 측면에서 담배 제품의 매력을 감소시키는 반면, 납세 증지는 공급 측면에서 불법 담배 유통을 억제하는 역할을 한다.
Regulations on Plain Packaging for Tobacco
The government has published three pieces of subsidiary legislation in the Gazette to advance the next phase of its ten tobacco control measures. These regulations establish specific legal requirements for the plain packaging of tobacco products and revise the health warning messages displayed on the packaging accordingly.
The legislation will be submitted to the Legislative Council on October 7 for "negative vetting," with the prescribed measures set to take effect on March 1, 2027. Following a nine-month grace period, full implementation is scheduled for December 1, 2027.
Plain packaging fundamentally diminishes the impact of branding by removing brand logos, varied colors, and decorative elements such as slogans or patterns. This approach has already been implemented in 27 countries and regions, where it has been empirically proven to effectively lower smoking rates.
Additionally, the government plans to strengthen the impact of health warnings by revising the 12 messages used over the past eight years. The amendments emphasize the consequences of related diseases, such as disability, physical disfigurement, and a reduced quality of life.
Furthermore, to prevent consumer confusion—given that some tobacco companies use terms like "light" or "low tar" to attract customers—the requirement to display tar and nicotine content on packaging has been removed.
The government explained that plain packaging and tobacco tax stamps serve complementary roles. While plain packaging reduces the appeal of tobacco products from the demand side, tax stamps act to curb the distribution of illicit tobacco from the supply side.
