건물주, 화재 안전 지침 미준수 벌금형
지난 화요일(9월 1일), 치안법원에서 한 건물주가 화재 안전(건축) 조례(FS(B)O)(제572장)에 따라 발령된 법정 지침을 준수하지 않은 혐의로 유죄 판결을 받고 61만 1,900 홍콩달러의 벌금을 부과받았다. 이 중 60만 5,900 홍콩달러는 위반 행위가 지속된 일수에 대한 벌금이다.
건축국(BD)은 FS(B)O 제5조(2)(a)(ii)항에 따라 삼수이포 캐슬 피크 로드에 위치한 복합 건물 한 동 소유주에게 화재 안전 건축 요건을 준수하도록 하는 법정 지침을 발령했다. 해당 요건에는 방화문 교체 및 비상계단으로 통하는 허가받지 않은 출입구를 방화벽으로 막는 작업이 포함되었다.
화재안전법(FS(B)O) 제5조(8)항에 따라 정당한 사유 없이 법정 지시를 준수하지 않는 사람은 범죄를 저지른 것으로 간주되며, 유죄 판결 시 6단계 벌금(현재 10만 홍콩달러)과 미준수 일수당 1만 홍콩달러의 추가 벌금에 처해질 수 있다.
Building Owner Fined for Non-Compliance with Fire Safety Guidelines
Last Tuesday (September 1), a building owner was found guilty at the Magistrates' Court of Police for failing to comply with statutory guidelines issued under Chapter 572 of the Fire Safety (Building) Ordinance (FS(B)O) and was fined HK$611,900. Of this amount, HK$605,900 is a fine based on the number of days the violation persisted.
The Building Bureau (BD) issued statutory guidelines to the owner of a building in a mixed-use complex located at Castle Peak Road in Sham Shui Po, pursuant to Article 5(2)(a)(ii) of the FS(B)O, requiring compliance with fire safety building requirements. These requirements included replacing fire doors and blocking unauthorized access points leading to emergency stairwells with firewalls.
Under Article 5 (8) of the Fire Safety (FS(B)O), any person who fails to comply with a court order without justifiable cause is deemed to have committed a crime and, upon conviction, may be subject to a fine of 6 tiers (currently 100,000 Hong Kong dollars) plus an additional fine of 10,000 Hong Kong dollars for each day of non-compliance.
