홍콩 세관, 불공정 거래 혐의를 받는 화장품 업체 관련 추가 체포
홍콩 세관은 9월 2일 스킨케어 제품 및 미용기기 판매에서 공격적인 상업 행위를 한 혐의를 받는 한 화장품 업체에 대한 후속 조치를 실시했다. 앞서 해당 업체의 재무 담당자와 관리 담당자가 체포된 데 이어, 세관은 오늘 해당 업체의 22세 여성 판매원을 상품 설명 조례(이하 "조례") 위반 혐의로 체포했습니다. 수사는 진행 중이며, 추가 체포 가능성도 배제할 수 없다.
세관은 현재까지 해당 화장품 업체와 관련된 총 38건의 신고를 접수했으며, 피해액은 약 3백만 홍콩달러에 달한다.
세관은 불공정 거래 행위의 피해를 입었다고 의심되는 소비자들에게 가능한 한 빨리 세관에 신고해 줄 것을 다시 한번 당부한다.
세관은 상인들에게 해당 조례의 요건을 준수할 것을 당부하며, 소비자들에게는 신뢰할 수 있는 상인을 이용할 것을 권고한다. 소비자는 상품이나 서비스를 구매하기 전에 침착하게 판단해야 합니다. 상품의 세부 사항과 가격을 충분히 이해하지 못했거나 구매를 원하지 않는 경우, 판매 계약서에 서명하거나 대금을 지불하는 것을 단호히 거부해야 한다.
해당 조례에 따라, 상인이 괴롭힘, 강압 또는 부당한 영향력을 행사하여 소비자의 선택의 자유나 행동을 제한하거나 저해함으로써 소비자가 거래를 결정하도록 유도하는 경우, 공격적 상업행위로 간주된다. 유죄 판결 시 최대 50만 달러의 벌금과 5년 이하의 징역형에 처해질 수 있다.
Hong Kong Customs Makes Additional Arrests Related to Cosmetics Company Suspected of Unfair Trade Practices
On September 2, Hong Kong Customs took follow-up action against a cosmetics company suspected of engaging in aggressive commercial practices in the sale of skincare products and beauty devices. Following the earlier arrest of the company's finance and management officials, Customs today arrested a 22-year-old female salesperson on charges of violating the Product Description Ordinance (hereinafter the "Ordinance"). The investigation is ongoing, and the possibility of further arrests cannot be ruled out.
To date, Customs has received a total of 38 reports related to the cosmetics company, with damages amounting to approximately HK$3 million.
Customs once again urges consumers who suspect they have been victimized by unfair trade practices to report them to Customs as soon as possible.
Customs urges merchants to comply with the requirements of the Ordinance and advises consumers to use trustworthy merchants. Consumers should exercise composure and make sound judgments before purchasing goods or services. If you do not fully understand the details and price of a product or do not wish to purchase it, you must firmly refuse to sign the sales contract or make payment.
Under the applicable ordinance, if a merchant induces a consumer to decide to make a transaction by restricting or hindering the consumer's freedom of choice or action through harassment, coercion, or the exercise of undue influence, it is considered aggressive commercial conduct. Upon conviction, the penalty may be a fine of up to $500,000 and imprisonment for up to five years.
