홍콩남성, 허위결혼 혐의 징역형
홍콩 남성이 사기 공모 혐의 1건과 허위 진술 혐의 1건으로 기소되었다.그는 샤틴 치안법원에서 혐의를 인정했으며, 징역 16개월을 선고받았다.
이민국(ImmD) 해외 조사과는 정보 분석을 통해 32세 피고인이 2025년 2월 홍콩에 거주하는 중국 본토 여성과 결혼한 사실을 확인했다. 해당 여성은 이후 피고인과의 혼인 관계를 이용하여 홍콩의 한 사립 병원에서 출산 예약 확인서를 발급받았다. 이 여성은 같은 해 6월 출산을 위해 홍콩 입국을 시도했다. 피해자는 피고인과의 혼인 관계에 대한 의혹으로 이민국으로부터 입국 허가를 거부당했고, 결국 중국 본토에서 출산했다.
이민국의 후속 조사 과정에서 피고인이 체포되었다. 피고인은 브로커의 주선으로 중국 본토 여성 거주자와 위장 결혼을 하여 그녀의 홍콩 방문 비자 및 영주권 취득을 돕는 대가로 약 5만 홍콩달러의 금전적 보상을 받았다. 또한 피고인은 중국 본토 여성 거주자가 홍콩에서 출산할 수 있도록 출산 예약 확인서를 발급받도록 돕기 위해, 임신한 아이의 친부가 자신이 아니라는 사실을 알면서도 고의로 허위 진술서를 제출했다고 인정했다. 다른 용의자들에 대한 조사는 계속 진행 중이며, 이민국은 추가 체포 가능성을 배제하지 않고 있다.
이민국은 위장혼 근절을 위해 모든 노력을 다할 것이다. 부정한 방법으로 홍콩 거주권을 취득한 사람은 홍콩 법에 따라 홍콩 신분증과 거주 자격이 무효화되며, 본국으로 추방될 것이다."라고 이민국 대변인이 밝혔다.
이민법에 따르면, 이민국 직원에게 자신이 허위임을 알거나 사실이라고 믿지 않는 진술이나 표현을 하는 사람은 범죄를 저지르는 것으로 최고 hkd15만 벌금 징역 14년이 주어진다.
형법에 따라 고의로 이민국에 허위 진술서를 작성하는 사람은 기소될 수 있으며, 유죄 판결 시 최대 2년의 징역형에 처해질 수 있다.
Hong Kong Man Sentenced to Prison for Falsified Marriage
A Hong Kong man has been charged with one count of conspiracy to commit fraud and one count of making false statements. He pleaded guilty at Sha Tin Magistrates' Court and was sentenced to 16 months in prison.
Through intelligence analysis, the Overseas Investigation Division of the Immigration Department (ImmD) confirmed that the 32-year-old defendant married a mainland Chinese woman residing in Hong Kong in February 2025. The woman subsequently used her marital relationship with the defendant to obtain a confirmation of a delivery appointment at a private hospital in Hong Kong. In June of the same year, she attempted to enter Hong Kong to give birth. Due to suspicions regarding her marital relationship with the defendant, the Immigration Department denied her entry and she eventually gave birth in mainland China.
The defendant was arrested during a follow-up investigation by the Immigration Department. The defendant received approximately HK$50,000 in financial compensation in exchange for facilitating a sham marriage with a mainland Chinese resident arranged by a broker to help her obtain a Hong Kong visitor visa and permanent residency. Furthermore, the defendant admitted to intentionally submitting a false statement, knowing full well that he was not the biological father of the unborn child, in order to help a female resident from mainland China obtain a birth reservation confirmation so she could give birth in Hong Kong. Investigations into other suspects are ongoing, and the Immigration Department is not ruling out the possibility of further arrests.
"The Immigration Department will make every effort to eradicate sham marriages. Anyone who obtains Hong Kong residency through fraudulent means will have their Hong Kong identity and residency status revoked under Hong Kong law and will be deported to their home country," an Immigration Department spokesperson stated.
According to the Immigration Act, anyone who makes a statement or expression to an Immigration Department employee knowing it is false or not believing it to be true is committing a crime punishable by a fine of up to HKD 150,000 and imprisonment for up to 14 years.
Under the Criminal Act, anyone who intentionally writes a false statement to the Immigration Department may be prosecuted and, if convicted, face imprisonment for up to two years.
