건물주, 철거 명령 미준수 혐의로 5만 홍콩달러 이상 벌금형 선고
한 건물주가 지난 금요일(8월 28일) 툰문 지방법원에서 건축 조례(BO)(제123장)에 따라 발부된 철거 명령을 지속적으로 불준수한 혐의로 유죄 판결을 받고 총 53,700 홍콩달러의 벌금을 부과받았다. 이 중 23,700달러는 위반 행위가 지속된 일수에 대한 벌금이다.
노스 포인트 킹스 로드에 있는 복합 건물 옥상에 약 84sqft 면적의 무허가 구조물이 설치되었다. 해당 무허가 건축 공사(UBW)는 건축부(BD)의 사전 승인 및 동의 없이 진행되었으므로, 건물주에게 건축 조례 제24조(1)항에 따라 철거 명령이 발부되었으나. 건물주는 철거 명령을 이행하지 않아 건축국(BD)으로부터 두 차례 기소되었고, 법원에서 유죄 판결을 받아 벌금형을 선고받았다

정당한 사유 없이 철거 명령을 이행하지 않는 것은 건축법(BO)에 따라 중대한 범죄이다. 유죄 판결 시 최대 20만 홍콩달러의 벌금과 1년 이하의 징역형에 처해질 수 있으며, 위반 행위가 지속되는 매일 최대 2만 달러의 추가 벌금이 부과된다.
Building Owner Fined Over HK$50,000 for Non-Compliance with Demolition Order
A building owner was found guilty last Friday (August 28) at the Tuen Mun District Court of a continuous non-compliance with a demolition order issued under Chapter 123 of the Building Ordinance (BO) and was fined a total of HK$53,700. Of this amount, HK$23,700 is a fine based on the number of days the violation continued.
An unauthorized structure covering an area of approximately 84 sq ft was installed on the roof of a mixed-use building on North Point Kings Road. Since the unauthorized construction (UBW) proceeded without prior approval and consent from the Building Department (BD), a demolition order was issued to the building owner pursuant to Section 24(1) of the Building Ordinance, but The building owner was prosecuted twice by the Building and Construction Bureau (BD) for failing to comply with a demolition order, found guilty in court, and sentenced to a fine.
"Failure to comply with a demolition order without just cause can lead to serious consequences. The building owner must comply with the demolition order without delay."
"Failure to comply with a demolition order without just cause is a serious crime under the Building Act (BO). Upon conviction, the penalty may be a fine of up to HK$200,000 and imprisonment for up to one year, with an additional fine of up to HK$20,000 imposed for each day the violation continues."
