변호사법 개정안
홍콩 법무부(DoJ)는 전국인민대표대회 상무위원회(NPCSC)에서 통과된 중국 변호사법 개정안을 환영했다.
개정안은 다음주 화요일 9월 1일부터 발효된다. 개정된 변호사법 제62조는 국무원 사법행정부가 주관하는 광둥-홍콩-마카오 대만구(GBA) 변호사 자격시험에 합격하고 중국 본토 변호사 자격증을 취득한 홍콩 특별행정구 및 마카오 특별행정구 변호사가 광둥성 광저우, 선전, 주하이, 포산, 후이저우, 둥관, 중산, 장먼, 자오칭시에서 지정된 법률 분야에서 변호사 활동을 할 수 있도록 규정했다.
국무원 사법행정부는 또한 시험 응시 자격 요건, 변호사 개업 신청 절차, 그리고 허용되는 업무 범위 등을 명시했다.
폴 람 법무부 장관은 개정된 변호사법이 광둥-홍콩-마카오 대만구(GBA) 변호사 제도를 명확히 규정함으로써, 변호사 활동의 정규화를 위한 법적 근거를 마련했다고 밝혔다.
제15차 국가 5개년 계획은 GBA 건설을 심화하고 국제적인 일류 해안 지역으로의 발전을 가속화할 것을 요구하고 있다. GBA에서 이중 전문 자격을 갖춘 변호사들은 GBA 내 메커니즘과 규제 체계 간의 연계를 원활하게 할 뿐만 아니라, 국가 전체의 발전에 적극적으로 참여하고 기여할 수 있다.
전국인민대표대회 상무위원회는 2020년 8월 국무원에 3년간 시범 사업을 시행할 권한을 부여했다.
올해 6월까지 650명 이상의 홍콩·마카오 변호사가 광둥-홍콩-마카오 대만구(GBA) 변호사 자격증을 취득하여 중국 본토 법이 적용되는 특정 민사 및 상사 사건에 대해 대만구 9개 직할시에서 법률 서비스를 제공할 수 있게 되었다.

The U.S. Department of Justice (DoJ) stated that it has agreed to the Chinese Attorney Law received from the Standing Committee of the National People's Congress (NPCSC).
The situation will become calm starting next week, September 1. Article 62 of the Attorney Law stipulates that attorneys from the Guangdong-Hong Kong-Macau Greater Bay Area (GBA) who have passed the attorney qualification exam administered by the Hunter administration may practice law in litigation matters in Guangdong Province, Zhuhai, Foshan, Hui, Dongguan, Zhongshan, Jiangmen, and Zhaoqing cities.
The Hunter administration has also registered exceptions regarding exam eligibility, the application procedure for opening an attorney practice, and the permitted scope of practice.
The Department of Justice is granted the authority to authorize the qualification of attorney activities as the appointed Attorney Law regulates the Guangdong-Hong Kong-Macau Greater Bay Area (GBA) attorney system. The 15th Five-Year Plan calls for urging the construction of the GBA and celebrating the development of an international first-class coastal region. Lawyers with double professional qualifications in the GBA can not only form partnerships with medical institutions within the GBA but also participate in and contribute to the overall development of the nation.
In August 2020, the Standing Committee of the National People's Congress authorized the U.S. military to lead the ACE program for three years.
As of June this year, it can be said that 650 lawyers from Lai and Macau are able to provide litigation services in the nine municipalities directly under the central government of the Greater Bay Area (GBA) for specific civil and Supreme Court cases subject to full Chinese local law, handled by lawyers in the Guangdong-Hong Kong-Macau Greater Bay Area (GBA).
