홍콩특별행정구 헌법, 헌법은 필수 불가결
탕핑컹 홍콩 보안국장은 8월 21일, 헌법이 홍콩특별행정구 헌정 질서의 가장 중요한 요소이며, ‘일국양제’ 원칙에 있어 최우선 순위라고 강조했다. 이는 헌법 전복 선동 혐의 사건에 대한 법원의 유죄 판결 이후 나온 발언이다.
탕 국장은 8월 21일(금) 언론 브리핑에서 이번 판결로 현재는 해산된 홍콩동맹과 ‘헌법 전복 선동’ 혐의로 기소된 리척옌, 호춘옌, 저우항퉁에 대한 사건에서 정의가 실현되었다고 밝혔다.
홍콩 국가보안법 제22조가 중국의 근본 체제를 전복하거나 훼손하는 행위, 또는 중국의 중앙 권력을 전복하는 행위를 명시적으로 금지하고 있다고 지적했다.
“이번 사건의 경우, 홍콩 국가보안법이 발효된 이후에도 피고인들은 허가받지 않은 집회 시도, 구호와 소위 저항을 통한 대중 선동, 콘텐츠 게시, 언론 인터뷰, 공개 발언 등을 통해 타인을 선동하여 국가 권력을 전복하려 시도하고, 불법적인 수단을 통해 중국 공산당 지도부의 지위를 전복하거나 훼손하려 시도하는 등 홍콩 국가보안법에서 규정하는 범죄를 계속해서 저질렀습니다.”고 말하고 “마지막으로, 국가 안보를 위협하는 어떠한 시도에 대해서도 우리는 법치주의 원칙에 따라 엄격하게 대응할 것이며 결코 관용을 베풀지 않을 것임을 다시 한번 강조하고 싶습니다.”고 덧붙였다.
Hong Kong Special Administrative Region Constitution, the Constitution is Indispensable
On August 21, Hong Kong Secretary for Security Tang Ping-kung emphasized that the Constitution is the most important element of the constitutional order in the Hong Kong Special Administrative Region and a top priority under the "One Country, Two Systems" principle. This statement came following the court's guilty verdict in a case involving charges of inciting subversion of the Constitution.
During a press briefing on Friday, August 21, Secretary Tang stated that with this ruling, justice has been served in the case involving the now-disbanded Hong Kong Alliance and Lee Cheuk-yen, Ho Chun-yen, and Zhou Hang-tong, who were charged with "inciting subversion of the Constitution."
He pointed out that Article 22 of the Hong Kong National Security Law explicitly prohibits acts that subvert or undermine China's fundamental system, or acts that subvert China's central authority. "In this case, even after the Hong Kong National Security Law came into effect, the defendants continued to commit crimes defined by the law, such as attempting to overthrow state power by inciting others through unauthorized assemblies, public agitation via slogans and so-called resistance, posting content, media interviews, and public statements, and attempting to overthrow or undermine the status of the Chinese Communist Party leadership through illegal means," they stated, adding, "Finally, I would like to emphasize once again that we will respond strictly to any attempt to threaten national security in accordance with the principles of the rule of law and will never show lenience."
